The Site and its components (such as the texts, photographs, trademarks, logos, illustrations, animations, graphic representations, diagrams, clips, videos, domain names, etc...) are protected worldwide by intellectual property rights, other proprietary rights and other laws, and, unless otherwise provided, are the exclusive property of DBAPPAREL UK or are licensed to DBAPPAREL UK. All such rights are reserved.

IF ANY PART OF THESE CONDITIONS SHALL BE DEEMED INVALID, VOID OR FOR ANY REASON UNENFORCEABLE BY A COURT OF COMPETENT JURISDICTION, THAT PART SHALL BE DEEMED SEVERABLE AND SHALL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF ANY REMAINING PART OF THESE CONDITIONS.

APPLICABLE LAW AND JURISDICTION

By visiting the Site, you agree: (a) that English law, without regard to principles of conflict of laws, will govern these Conditions; and (b) that the English courts will have exclusive jurisdiction over any claim arising from, or related to, the Site (including its use or access) although DBAPPAREL UK shall have the right to bring proceedings against you in your country of residence or any other relevant country.

DBAPPAREL UK and any affiliate company, which means our subsidiaries, our ultimate holding company and its subsidiaries, acknowledge the importance of protecting the privacy of all the users of the Site. Access and use of the Site is subject to this confidentiality and protection of personal data policy (hereinafter “Privacy Policy”). The Privacy Policy governs how DBAPPAREL UK and any affiliate company will gather, process and disclose personal data that you provide through the Site.

For the purpose of the Data Protection Act 1998, the data controller is DBAPPAREL UK.

DBAPPAREL UK may disclose your personal information to any affiliate company, which means our subsidiaries, our ultimate holding company and its subsidiaries.

You acknowledge and agree that by sending Unsolicited Information, you provide DBAPPAREL UK with a perpetual, irrevocable, non-exclusive, worldwide, royalty-free and transferable licence to use the Unsolicited Information for any purpose whatsoever and with a full right to sub-license. DBAPPAREL UK has no obligation to respond or confirm its reception, and has only a right to use it but no obligation. DBAPPAREL UK may disclose your identity to any person who claims that Unsolicited Material sent by you infringes their intellectual property rights, any other proprietary right, privacy rights, or is defamatory/libellous.

You agree that the content of any Unsolicited Information may be used by DBAPPAREL UK, with no financial compensation for yourself or any other person, reproduced, presented, modified, disclosed, published, displayed, printed, copied, translated, distributed, adapted, grouped, transferred to any third party of its choice, transmitted to anyone, separately or together with other works, on any current or future medium whatsoever, using any current or future process and for all purposes, notably but not limited to promotional purposes, advertising purposes, the development and marketing of products or any other commercial purpose.

CONTRIBUTIONS AND SUBMISSIONS TO THE SITE

You may be invited to make certain contributions or submissions to appear on the Site (including, without limitation, submitting emails, diaries, stories, commentaries, descriptions, blog entries, reviews, opinions, videos, photos, illustrations, and other material), whether by email, post, or by uploading such material to the Site (hereafter referred to as “Contributions”).

Any Contributions submitted by you will be considered non-confidential and non-proprietary. You further agree that your Contribution may be posted on the Site and be used by DBAPPAREL UK in any other way, with no financial compensation for yourself or any other person, including being reproduced, presented, modified, disclosed, published, displayed, printed, copied, translated, distributed, adapted, grouped, transferred to any third party of its choice, transmitted to anyone, separately or together with other works, on any current or future medium whatsoever, using any current or future process and for all purposes, notably but not limited to promotional purposes, advertising purposes, the development and marketing of products or any other commercial purpose. DB APPAREL may at its discretion decide not to use any of your Contribution or any part of your Contribution.

DBAPPAREL UK shall not be liable to you for any loss or damage arising out of posting any Contribution on the Site, including where caused by unauthorised use or alteration of the content or other interference of the website.

You shall be responsible for ensuring that you have obtained all third party consents required in connection with the use of your Contribution as stated above, including the consent of any third party appearing in the Contribution, and you hereby warrant that your Contribution does not infringe any third party intellectual property rights, does not violate any proprietary right, privacy rights, or any other third party right, is not defamatory or libellous and is in compliance with all applicable law and regulation. You agree to indemnify DBAPPAREL UK and its affiliates, agents and representatives from and against any costs, expenses, loss or liability whatsoever, including without limitation incurred pursuant to any third party claim, arising out of or in connection with your Contribution. We have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, their right to privacy or any other right.

SECURITY

Unfortunately, the transmission of information via the Internet is not secure and cannot be completely protected from illicit interference from third parties. Communications via the Internet may potentially be intercepted, lost or modified and any transmission is therefore at your own risk. Once DBAPPAREL UK receives the information, it will employ security features to attempt to prevent unauthorised access.

Please note that the tests are not based on any official or scientific methodology, but are done at random. The purpose is simply to showcase the Ultimate Strapless in action.

WONDERBRA ULTIMATE STRAPLESS PARTY – TERMS & CONDITIONS

  1. Participation signifies acceptance of these terms and conditions, including the instructions to this promotion which form part of these terms and conditions.
  2. Open to residents of the UK aged 18 or over, excluding employees (and their immediate families) of the Promoter, its agents or anyone professionally connected with the promotion.
  3. Purchase is not necessary. Entry to the prize draw is via website at www.ultimatestrapless.co.uk/party where you will be asked to complete an on-line entry form, which must be properly completed in full. Only one entry per person.
  4. All entries must be received by 11:59pm 15th November 2009, the Closing Date. Responsibility cannot be accepted for entries not properly completed or not received or received late due to technical, communication or other problems.
  5. 40 winning entries will be selected at random from all valid entries, and each winning entry will receive the prize as described below:
    a) 2 VIP entry tickets to the Wonderbra Ultimate Strapless Party (the “Event”), for the winner and her friend. The winner and her friend must both be 18 or over and ID will be required to claim the prize and on the night of the Event as further explained in these terms.
    b) Each winner will receive a free Wonderbra Ultimate Strapless bra for her and her friend. The Promoter will endeavour to provide sizes of choice, but in the event these are not available, will provide the nearest available sizes.
    c) The Event will be held at Punk, Soho, London or an alternative venue in London if for whatever reason the Punk is unavailable (the “Venue”). The Event will be held on Thursday 26th November 2009 and commence at 7.30pm, subject to any changes to the date and time due to unavoidable circumstances. Any changes will be notified in advance to the winner.
    For the avoidance of doubt, the prize does not include anything else, including any insurance or any other costs and expenses that may be incurred.
  6. The draw will be supervised by an independent judge. The draw will take place and the winners will be notified within a maximum of 5 days after the Closing Date.
  7. Prizes must be claimed within 24 hours of the date of notification, otherwise the prize may be forfeited at the Promoter’s discretion or passed on to a reserve list of winners. To claim the prize, each winner will be required to provide the Promoter with (i) confirmation of their name, address and name and address of their chosen friend; (ii) confirmation of the preferred bra size for her and her friend; and (iii) provide two separate pieces of photo ID for herself and two separate pieces of photo ID for her friend confirming their age (e.g. copy of passport and driving licence).
  8. The winner and her friend will have their name on a guest list on the night of the Event and will each be required to show photo ID before they are able to obtain entry to the Event. Winners and their friends must comply with the Event dress code, which is strictly strapless.
  9. The winner and her guest must behave appropriately at all times at the Event and fully comply with the rules and regulations of the Venue and all instructions issued by the Venue and the organisers on the night of the Event. The organisers may refuse entry or ask the winner and/or guest to leave the Event at any time if in the absolute discretion of the organisers there is any inappropriate behaviour.
  10. With regard to the Venue, standard operator terms apply and the winner and her guest must at all times comply with such terms, rules and regulations.
  11. The Promoter shall not be liable in any way and does not accept any responsibility for any act or omission of the Venue or any other third party, for any delays or cancellation or unavailability of any service or facility or for any inconvenience, accident or injury, loss or damage to property or possessions, or for any other loss or liability whatsoever, except for death or personal injury caused by Promoter’s own negligence.
  12. For the name and county of the prize winners, send a stamped SAE to the Promoter’s address set out below, marked “Winner – Wonderbra Ultimate Strapless Party”.
  13. Prize is non-transferable and non-refundable and there are no cash alternatives.
